- Accurex B.V. is a private company with limited liability, incorporated under Dutch law, with its registered office in Rotterdam and listed in the Trade Register of the Chamber of Commerce under number 95504001.
- In these General Terms and Conditions the term ‘persons affiliated with Accurex B.V.’ means: any expert or other (legal) person employed by Accurex B.V., regardless of whether this is based on an employment contract or another legal relationship.
- Where these General Terms and Conditions refer to ‘the Client’, this also includes all clients who have jointly issued one assignment, as well as his or their authorised representatives.
- These General Terms and Conditions apply to all offers, quotations and assignments to which Accurex B.V. is a party, as well as to the realization of these agreements and the execution thereof and all legal relationships resulting from or related to them.
- Applicability of any general terms and conditions of the Client is expressly rejected.
- All persons affiliated with Accurex B.V. may invoke these General Terms and Conditions.
- All assignments shall be deemed to have been given to Accurex B.V., even if it is the intention that a person specifically affiliated with Accurex B.V. carry out this assignment.
- The client cannot invoke Articles 7: 404, 7:407(2) and 7:409 of the Dutch Civil Code.
- The client shall not use all reports and instructions received by Accurex B.V. within the scope of the performance of the assignment for any purpose other than that for which they are intended.
- The client owes an agreed fee, possibly increased with VAT, which is based on the hours spent at an agreed hourly rate, increased with the costs incurred, including mileage costs
- Accurex B.V. reserves the right to increase the hourly rates and other fees charged.
- The Principal may submit objections to a bill of costs until 14 days after the bill date. Thereafter, the invoice is deemed to be accepted.
- The Client shall pay the invoice within 30 days after the invoice date.
- Any liability of Accurex B.V. and persons affiliated with Accurex B.V. is limited to the amount paid out by the professional liability insurer, increased by the excess. If for whatever reason no payment is made by the professional liability insurer, then liability shall be limited to the invoices issued up to that moment in relation to the assignment granted, with a maximum of € 25,000.
- Accurex B.V. may process the (personal) data of the Client in accordance with the conditions in the Privacy Statement published at www.Accurexbv.nl.
- The (legal) relationship between Accurex B.V. and the Client is governed by Dutch law. Disputes can only be decided by the competent court in Rotterdam.
